DATA PROTECTION POLICY FOR EMPLOYEES

This policy (the “Policy”) sets out the framework for the protection of relevant data and information relating to employees of SAVVICE Corporation (formerly known as Southbend Express Services Incorporated (“SAVVICE”), including the collection, use, disclosure and processing of such data and information, in accordance with Republic Act No. 10173 or the Data Protection Act of 2012 (“DPA”). This Policy applies to Personal Data in the possession or under the control of SAVVICE, including Personal Data in the possession of organizations which SAVVICE has engaged to collect, use, disclose or process Personal Data for our purposes.

DATA PROTECTION POLICY FOR EMPLOYEES

Unless otherwise expressly defined herein, capitalized terms shall have the meanings ascribed to them under the DPA and/or the relevant implementing rules and regulations.

APPLICATION OF THIS POLICY

This policy applies to all persons engaged in a contract of employment or service with SAVVICE regardless of the nature of such contractual relationship, whether on a part-time, temporary or full-time basis, including persons engaged as interns and trainees under agreement or contract with SAVVICE (collectively referred to as “SAVVICE Employees”).

PERSONAL DATA/INFORMATION

As used in this Policy, consistent with the DPA, “Personal Information” shall refer to any information whether recorded in a material form or not, from which the identity of an individual is apparent or can be reasonably and directly ascertained by the entity holding the information, or when put together with other information would directly and certainly identify an individual.
“Sensitive Personal Information” shall refer to refers to personal information:
1. about an individual’s race, ethnic origin, marital status, age, color, and religious, philosophical or political affiliations;
2. About an individual's health, education, genetic or sexual life of a person, or to any proceeding for any offense committed or alleged to have been committed by such person, the disposal of such proceedings, or the sentence of any court in such proceedings;
3. Issued by government agencies peculiar to an individual which includes, but not limited to, social security numbers, previous or current health records, licenses or its denials, suspension or revocation, and tax returns; and
4. Specifically established by an executive order or an act of Congress to be kept classified.
For purposes of this Policy, Personal Information and Personal Sensitive Information shall be collectively referred to as Personal Data, as the context may require.
Subject to relevant and applicable law, Personal Data that may be collected by SAVVICE pursuant to the Employees’ contract/engagement with SAVVICE shall include (among others, as may otherwise be informed to the Employees):
1. complete name, employee number/ID number, nickname, gender, height, weight, blood type, civil status, SSS No./TIN No./ HDMF No./ PHIC No., tax status, date of birth, nationality, religion and place of birth;
2. provincial and current mailing address, contact numbers, contact person in case of emergency, contact number in case of emergency, email address and other contact details;
3. payroll account number, hire date, regularization date, separation date, separation reason, end of contract;
4. employment status, position title/name, pay grade / employee level,
5. division name, department name, section name, job location / site,
6. payroll primary approver, payroll back up approver, work shift;
7. educational background, statutory contributions (BIR, HDMF, PHIC, SSS);
8. timekeeping raw data), payslip (for payroll processes / audits);
9. annual physical exam, executive check up results, and other medical records;
10. employee movements, performance appraisal ratings,
11. list of trainings attended;
12. salary rate, COC records, job description, certifications / licenses;
13. dependents names / records
14. previous employers, resume, application form, exam results;
15. other 201 file records
16. any additional information provided to SAVVICE by the Employee as a job applicant (that is, prior to being engaged as an employee).

COLLECTION, USE AND DISCLOSURE OF PERSONAL DATA

SAVVICE generally collects Personal Data that the Employees (a) knowingly and voluntarily provide in the course of or in connection with their employment with SAVVICE, or via a thirdparty who has been duly authorized by the respective Employees to disclose his/her Personal Data to SAVVICE, which may include the Employee’s job placement agent, after (i) the Employee has been notified of the purposes for which the Personal Data is collected, and (ii) the Employee (or his/her authorized representative) has provided written consent to the collection and usage of his/her Personal Data for those purposes, or (b) the collection and use of Personal Data without consent is permitted or required by the other relevant laws. SAVVICE shall seek the Employee’s consent before collecting any additional Personal Data not otherwise listed in this Policy and before using Personal Data for a specific purpose not otherwise indicated herein or notified to the Employee (except where permitted or authorized by law).
Personal Data of the Employee shall be collected and used by SAVVICE, including the disclosure of such Personal Data to third parties where necessary, for the following purposes:
1. Health Plan Coverage
2. Life Insurance Coverage
3. Payroll Processing
4. Payroll Processing Audits (Internal and External)
5. Payroll Uploading / Crediting
6. Annual Physical Exam / Executive Check Ups
7. Employee 201 File / HRIS / HCM
8. Statutory Remittance Compliance (BIR, HDMF, PHIC, SSS)
9. Business Permit Applications
10. Renewal of LTO CSU with PNP SOSIA
11. Employment Verification for Loan Applications (Internal & External)
12. Compensation and Benefits Studies
13. Department of Labor & Employment Reports
14. COC
15. Background checking
16. NLRC
17. PSA Reports
18. Employee Surveys
19. Training - Related Requirements
20. Recruitment Processes
21. Performance Management System
22. Succession Management
23. Competency Management
24. Security and safety related processing activities (such as, but not limited to, entry & exit logging, building access / proximity processing, etc.)
25. Photo, audio and video recording and storage within company premises and companysponsored activities
26. Internal and external audits reporting and responses
27. Legal compliance and regulatory related processes, including administrative, labor, civil and/or criminal cases that may be filed by or against the employees
28. Internal and external communication thru digital and traditional platform in relation to company publications / directory or general information / press or news releases / TV appearance / company events
29. Operations and non-operations technology requirement processes – processing for operations systems such as but not limited Toll collection systems, account management systems, Enterprise Resource Planning (“ERP”), event forms, and human capital management systems
30. Reimbursements and request for payments
31. Attendance processing
32. Business-related travel processing
33. Company certification activities such as ISO, IMS
34. Company shuttling and vehicle fleet management related processing
35. Corporate Governance processes and activities.
The purposes listed in the above clauses may continue to apply even in situations where the Employee’s relationship with SAVVICE (for example, pursuant to a contract) has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable SAVVICE to enforce its rights under any contract, law or equity, with or against the Employee).

ACCESS TO AND CORRECTION OF PERSONAL DATA

If the Employee wishes to make a request (a) to access Personal Data which SAVVICE holds about the Employee or information about the ways in which SAVVICE uses or discloses such Personal Data, or (b) to correct or update any of such Employee’s Personal Data which SAVVICE holds, the Employee may submit such request in writing or via email to our Data Protection Officer/Compliance Officer for Privacy at the contact details provided below.

PROTECTION OF PERSONAL DATA

To safeguard Personal Data from unauthorized access, collection, use, disclosure, copying, modification, disposal or similar risks, SAVVICE has introduced appropriate administrative, physical and technical measures such as up-to-date antivirus protection, encryption and the use of privacy filters to secure all storage and transmission of Personal Data by SAVVICE, and disclosing Personal Data both internally and to authorized third party service providers and agents only on a need-to-know basis.
The Employee acknowledges that no method of transmission over the Internet or method of electronic storage is completely secure. While security cannot be guaranteed, SAVVICE has taken reasonable steps to protect the security of Personal Data and is constantly reviewing and enhancing its information security measures.

ACCURACY OF PERSONAL DATA

SAVVICE generally relies on Personal Data provided by the Employee. In order to ensure that the Personal Data is current, complete and accurate, the Employee shall have the obligation to update SAVVICE if there are changes to his/her Personal Data by informing SAVVICE’s Data Protection Officer, thru Human Resource Department.

RETENTION OF PERSONAL DATA

SAVVICE may retain Personal Data for as long as it is reasonably necessary to fulfill the purposes for which they were collected, or as required or permitted by applicable laws.
SAVVICE will cease to retain Personal Data, or remove the means by which the data can be associated with the Employee, as soon as it is reasonable to assume that such retention no longer serves the purposes for which the Personal Data were collected, and are no longer necessary for legal or business purposes.

EFFECT OF POLICY AND CHANGES TO POLICY

This Policy applies in conjunction with any other policies, notices, contractual clauses and consent clauses that apply in relation to the collection, use and disclosure of Personal Data by SAVVICE.
SAVVICE may revise this Policy from time to time without any prior notice. Employees shall be asked to reaffirm consent for every amendment on this policy.

CONSENT CLAUSE FOR EMPLOYEES

The Employee acknowledges that he/she has read and understood this Policy and consents to the collection, use and disclosure of Personal Data by the organization for the purposes set out in this Policy. The Employee may withdraw his/her consent for such collection, use and disclosure, and make an access or correction request in respect of his/her Personal Data, in accordance with the Policy. Nevertheless, the Employee acknowledges that such withdrawal may affect the ability of SAVVICE to comply with and fulfill its obligations relating to the purposes for which such Personal Data is processed. In which case, SAVVICE shall not be held liable and shall be held free and harmless by the Employee from any claim, action or damage arising from or in connection with such withdrawal.

By signing this form,
(a) the Employee acknowledges that he/she has read, understood and agreed to the above Policy, and consent to the collection, use and/or disclosure of his/her Personal Data by SAVVICE for the purposes set out in the Policy; and

(b) in the event that SAVVICE has received the Employee’s Personal Data from any third party pursuant to the purposes set out in the Policy, the Employee warrants that such third party has been duly authorized by the Employee to disclose his/her Personal Data to SAVVICE for the purposes set out in the Policy.
